4th Successful IVC Filter Verdict for Ben Martin Law Group Awards Plaintiff $386,250
A federal jury on July 21, 2021 found that C.R. Bard Inc.’s IVC blood clot filters were defective once again. This will be the fourth successful verdict against Bard for trial lawyers at Dallas-based Ben Martin Law Group. The jury awarded the plaintiff, Debra Branch, $386,250, bringing the combined total of $7 million in winnings for their clients.
The jury found that the Bard Recovery Filter was defective at the time it left the possession of the manufacturer, resulting in serious injuries. Branch’s implanted IVC filter perforated her vena cava wall causing other organs to be endangered; one of the struts from the device put a hole in her aorta requiring major surgery. A broken piece of the filter traveled to one of her lungs, and it remains there today.
Branch was suffering from severe back pain caused by the IVC filter. The filter prongs were touching her aorta, lumbar vertebra and vena cava wall. Surgery was imperative to remove the filter and other loose fragments surrounding the device and repair the inferior vena cava.
