Over the past few years, our trial successes include multi-million dollar jury verdicts against major IVC filter manufacturers, including a record $3 million dollar verdict in a bellwether IVC filter case filed in the Cook Medical MDL in Indianapolis. This verdict, which at the time was largest actual damages award ever obtained in any IVC filter case, was tried by a team of lawyers led by Ben C. Martin. The jury in Brand v. Cook Medical Inc. and William Cook Europe, found, for the first time, that a medical device company had defectively designed an IVC filter.
Since then, our trial lawyers have won four other IVC filter verdicts in jury trials against C. R. Bard, Inc. and Bard Peripheral Vascular, Inc. (“Bard”), including a $3.3 million actual damages verdict that broke the firm’s previous record, in one of the largest such awards nationwide in an IVC filter case.
Ben Martin Law Group’s recent trial successes are not limited to IVC filters; they include a wrongful death case tried in Dallas, Texas against a multi-billion dollar railroad company. In Rigsby v. Kansas City Southern Railway, a Dallas, Texas jury found the railroad responsible for the tragic death of a driver at a dangerous railroad crossing.

Ben is also on the Plaintiffs’ Steering Committee in the Cordis IVC filter litigation and is co-lead counsel in coordinated litigation pending in Philadelphia against Rex Medical regarding its Option IVC filter. Ben is an integral part of trial teams in IVC filter, transvaginal mesh, and other important cases pending in federal and state courts across the country.
